people say it's a fruit but I'm not sure yet.

Scientifically speaking, a tomato is definitely a fruit. True fruits are developed from the ovary in the base of the flower, and contain the seeds of the plant (though cultivated forms may be seedless). The confussion comes when we talk about cooking, as it is not used as the rest of the fruits.
